What a Valid Notice Must Contain
To be actionable under 17 U.S.C. §512(c)(3), your notice must include:
- identification of the copyrighted work you claim has been infringed;
- the exact URL(s) on BdsmVilla where the allegedly infringing material appears — one URL per item, so we can locate it;
- your contact information: name, mailing address, telephone number, and email;
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf;
- your physical or electronic signature.
Incomplete notices may be rejected. Knowingly misrepresenting that material is infringing can expose you to liability under 17 U.S.C. §512(f).
Counter-Notice
If your upload was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same address. It must include: identification of the removed material and its former URL, your name, address, and telephone number, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, consent to the jurisdiction of your local federal district court (or any judicial district in which we may be found, if you are outside the United States), and your signature. If the original complainant does not notify us within 10–14 business days that they have filed a court action, we may restore the material.
Repeat Infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Uploads from terminated accounts are removed, and we take reasonable steps to prevent re-registration for the purpose of re-uploading infringing material.
